EPA Proposed Rules on Trichloroethylene Uses: Comment Periods Extended

The Environmental Protection Agency (EPA) has extended the comment period by 30 days for two proposed rules banning certain uses of Trichloroethylene (TCE) under section 6 of the Toxic Substances Control Act (TSCA).

One of the proposed rules(81 FR 91592), which would ban commercial use of TCE for aerosol degreasing and for spot cleaning in dry cleaning facilities, will have the comment period extended to March 16th.

The second proposed rule(82 FR 7432), which would ban the commercial use of TCE in vapor degreasing, will have the comment period pushed back to April 19th.

Both rules propose to:

  • Prohibit the manufacture (including import), processing, and distribution in commerce of TCE¬† for the respective uses;
  • Require manufacturers, processors, and distributors, except for retailers of TCE for any use, to provide downstream notification of these prohibitions throughout the supply chain;
  • Require limited recordkeeping.
